Sick leave after hernia surgery – medical certificate, entitlements, and procedures
March 9, 202608:45After hernia surgery, sick leave is necessary for recovery and rehabilitation, which typically lasts 6 to 8 weeks, depending on the type of procedure and the individual’s health condition. Laparoscopic surgery requires a shorter rest period, while open surgery requires a longer one.
Eligible persons for sick leave and wage compensation:
- Insured employees, self-employed persons, company owners, professional athletes, and farmers (if insured).
- Unemployed persons are entitled only if they had the right to compensation before May 31, 2012.
Electronic medical certificate:
- It is issued by the personal doctor in agreement with the insured person (follow-up appointment, phone, or email).
- Deadline for issuance: no later than the end of the month for which the sick leave is claimed.
- The doctor is responsible for correctly entering it into the SPOT system.
Procedures for compensation:
- The employer pays the compensation, and the Health Insurance Institute of Slovenia (ZZZS) reimburses the amount after the claim is submitted.
- Self-employed persons submit a written application to ZZZS.
- Direct payment by ZZZS occurs if the employee’s employment relationship ends during sick leave.
Required applications and attachments:
- Electronic medical certificate, proof of justified absence from work.
- Special forms, e.g., for blood donation.
Restrictions during recovery: rest, gradual return to physical activities, monitoring of heavy lifting, proper wound care, and nutrition.
Legal basis: Employment Relationships Act, Health Care Act, Compulsory Health Insurance Act, and ZZZS guidelines for exercising insured persons’ rights.
